Resumen Este estudio tiene como objetivo perfilar el concepto de abuso de conciencia en vistas a su tipificación en el derecho canónico. Se comienza describiendo la reflexión postconciliar sobre la manipulación de conciencia desde una perspectiva teológico-moral, que anticipa el concepto actual de abuso de conciencia. El centro del artículo es el esclarecimiento del concepto de abuso de conciencia y de su gravedad. Este abuso se da en el contexto de relaciones de cuidado, donde se traspasan los límites de la (...) mediación eclesial que corresponde a dicha relación: el abuso de conciencia implica apropiarse indebidamente de la autoridad de Dios. El presente estudio continúa la línea de investigaciones precedentes para perfilar con mayor nitidez el abuso de conciencia propiamente tal en el contexto católico. Es un paso indis pensable para la necesaria justicia y reparación para las víctimas de este grave delito.This article offers a systematic characterization of abuse of conscience in order to its typification as a canonical crime. We begin exploring the study of conscience manipulation in moral theology after Vatican II as an important background for the understanding of abuse of conscience in more recent studies. The core statement of this study is the definition of abuse of conscience and its gravity. This kind of abuse is set within care relationships, where the abuser steps over the limits of his ecclesial mediation: he appropriates himself of God’s own authority. This study builds on this literature to understand abuse of conscience as a specific type of spiritual abuse in catholic settings. We understand this is absolutely necessary for justice and reparation towards victims. (shrink)

Promoting and protecting the public's health in the United States and abroad are intricately tied to laws and policies. Laws provide support for public health measures, authorize specific actions among public and private actors, and empower public health officials. Laws can also inhibit or restrict efforts designed to improve communal health through protections for individual rights or structural principles of government. Advancing the health of populations through law is complex and subject to constant tradeoffs. This column seeks to explore the (...) role of law in the interests of public health through scholarly and applied assessments across a spectrum of key issues. Currently, humanity is experiencing an explosive growth in technological objects designed to improve the body and mind. The main objective of this article is to review two recent classificatory and explanatory systems to cognitive enhancement cybernetic technologies, including both wearable and implantable artifacts that reorganize human embodiment or extend the mind. I argue that an outdated model of the cognitive sciences serves as the basis for these revised systems and taxonomies. Taking an embodied approach to the cognitive sciences, I propose (...) an alternative focus to classify cognitive enhancement cybernetic technologies. Specifically, by adopting a non-orthodox enactive approach to embodied cognition, I propose a new classificatory system that redefines the notion of the cybernetically enhanced human, restricting it to a purely cognitive context. This study explored drug users’ attitudes toward and understanding of randomized controlled trials testing addiction therapies. A video portraying a fictional consent conference for a randomized controlled trial with placebo arm was shown to poor male and female drug users of diverse ethnic status and sexual orientation. The video stimulated focus group discussion in which participants’ comments often reflected “experimental realism”—a realistic view of the trial—and adequate understanding of the uncertain efficacy of the treatment being tested, as well as the (...) concepts of randomization and placebo control. However, participants’ comprehension of the nature of placebos was compromised by the widespread view that placebos are a way of testing a subject’s willpower and personal control over his or her addiction. Comments also showed a mistrust of the video investigator’s integrity and competence and signs of therapeutic misconception and misestimation. The study’s findings underscore the importance of tailoring informed consent encounters to the personal and sociohistorical context of participants’ lived experiences. (shrink)

Common objects comprise living and non-living things people interact with in their daily-lives. Images depicting common objects are extensively used in different fields of research and intervention, such as linguistics, psychology, and education. Nevertheless, their adequate use requires the consideration of several factors, and careful validation procedures. The current study presents a systematic review of the available published norms for images of common objects. A systematic search using PRISMA guidelines indicated that despite their extensive use, the production of norms for (...) such stimuli with adult populations is quite limited, particularly for more ecological images, such as photos. Among the several dimensions in which the items were assessed, the most commonly referred in our sample were familiarity, visual complexity and name agreement, illustrating some consistency across the reported dimensions while also indicating the limited examination of other potentially relevant dimensions for image processing. The lack of normative studies simultaneously examining affective, perceptive and semantic dimensions was also documented. The number of such normative studies has been increasing in the last years and published in relevant peer-reviewed journals. Moreover, their datasets and norms have been complying with current open science practices. Nevertheless, they are still scarcely cited and replicated in different linguistic and cultural contexts. The current study brings important theoretical contributions by characterizing images of common objects stimuli and their culturally-based norms while highlighting several important features that are likely to be relevant for future stimuli selection and evaluative procedures. The systematic scrutiny of these normative studies is likely to stimulate the production of new, robust and contextually-relevant normative datasets and to provide tools for enhancing the quality of future research and intervention. Visuomotor adaptation to novel environments can occur via non-physical means, such as observation. Observation does not appear to activate the same implicit learning processes as physical practice, rather it appears to be more strategic in nature. However, there is evidence that interspersing observational practice with physical practice can benefit performance and memory consolidation either through the combined benefits of separate processes or through a change in processes activated during observation trials. To test these ideas, we asked people to practice aiming (...) to targets with visually rotated cursor feedback or engage in a combined practice schedule comprising physical practice and observation of projected videos showing successful aiming. Ninety-three participants were randomly assigned to one of five groups: massed physical practice, distributed physical practice, or one of 3 types of combined practice: alternating blocks, or all observation before or after blocked physical practice. Participants received 100 practice trials. All groups improved in adaptation trials and showed savings across the 24-h retention interval relative to initial practice. There was some forgetting for all groups, but the magnitudes were larger for physical practice groups. The Act and Obs_During groups were most accurate in retention and did not differ, suggesting that observation can serve as a replacement for physical practice if supplied intermittently and offers advantages above just resting. However, after-effects associated with combined practice were smaller than those for physical practice control groups, suggesting that beneficial learning effects as a result of observation were not due to activation of implicit learning processes. Reaction time, variable error, and post-test rotation drawings supported this conclusion that adaptation for observation groups was promoted by explicit/strategic processes. (shrink)

BackgroundMoral distress (MD) is an emotional and psychological response to morally challenging dilemmas. Moral distress is experienced frequently by nurses in the intensive care unit (ICU) and can result in emotional anguish, work dissatisfaction, poor patient outcomes, and high levels of nurse turnover. Opportunities to discuss ethically challenging situations may lessen MD and its associated sequela.ObjectiveThe purpose of this project was to develop, implement, and evaluate the impact of nursing ethics huddles on participants’ MD, clinical ethics knowledge, work satisfaction, and (...) patient care among ICU nurses.Sample and SettingThe sample, 32 nurses from three ICU settings in an 800-bed tertiary academic medical center, participated in six nursing ethics huddles over a two-month period.MethodsAlvita K. Nathaniel’s Theory of Moral Reckoning guided development of the nursing ethics huddle process.1 The Moral Distress Thermometer was administered at three data points: baseline level of MD, and pre- and post-huddle to determine changes in the subjects’ level of MD.2 Focused content analysis was used to analyze qualitative responses from questionnaires about the subjects’ perception of the effect of the huddles on work satisfaction and patient care. Knowledge attainment was evaluated via open-ended short-answer questions.ResultsOverall, use of nurse-ethicist-led nursing ethics huddles was associated with improved quality of work life, patient care, and clinical ethics knowledge. The change in pre- and post-nursing ethics huddles MD scores was statistically significant (p < 0.0001). (shrink)

We explore the various ethical challenges that arise during the practical implementation of an emergency resource allocation protocol. We argue that to implement an allocation plan in a crisis, a hospital system must complete five tasks: (1) formulate a set of general principles for allocation, (2) apply those principles to the disease at hand to create a concrete protocol, (3) collect the data required to apply the protocol, (4) construct a system to implement triage decisions with those data, and (5) (...) create a system for managing the consequences of implementing the protocol, including the effects on those who must carry out the plan, the medical staff, and the general public. Here we illustrate the complexities of each task and provide tentative solutions, by describing the experiences of the Coronavirus Ethics Response Group, an interdisciplinary team formed to address the ethical issues in pandemic resource planning at the University of Rochester Medical Center. While the plan was never put into operation, the process of preparing for emergency implementation exposed ethical issues that require attention. (shrink)

There is no doubt that many people find games helpful for understanding various logical phenomena. But we ask whether anything is really 'explained' by these accounts, and we analyse Paul Lorenzen's dialogue foundations for constructive logic as an example. The conclusion is that the value of games lies in their ability to provide helpful metaphors and representations, rather (...) than in any true conceptual analysis. In fact some of the standard explanations of logical notions in terms of competitive games simply don't work. /// [ Erik C. W. Krabbe] In an attempt to redeem the Lorenzen-type dialogues from their detractors, it is perhaps best first to provide a survey of the various benefits these dialogues have been supposed to yield. This will be done in Section I. It will not be possible, within the confines of this paper, to scrutinize them all, but in Section II we shall delve deeper into the capacity of this type of dialogue to yield a model for the immanent criticism of philosophical positions. Section III will extend the concept of a dialogue in such a way as to conform better with our intuitive conceptions of what a rational discussion of a position should contain. This will be followed up by a concept of 'winning a dialogue' that takes position midway between the old conception of 'winning one play' and that of the full-fledged presentation of a winning strategy. Concepts of 'rational discussion' are thus shown to be, plausibly, more fundamental than those of proof. In Section IV, I shall discuss the specific problems about dialogical foundations put forward by Wilfrid Hodges. (shrink)

In 1966, island biogeographer Sherwin Carlquist published a list of 24 principles governing long-distance dispersal and evolution on islands. The 24 principles describe many aspects of island biology, from long-distance dispersal and establishment to community change and assemblage. Although this was an active period for island biogeography, other models and research garnered much more attention than did Carlquist’s. In this review, over 40 years of support for or against Carlquist’s principles is presented. Recent work has supported most of the 24 (...) principles, and improved methodologies have generally substantiated his initial claims. However, Carlquist’s original work and ideas remain relatively under-represented in the biogeographic literature. Use of philosophical model domains provides one explanation as to why Carlquist’s work has received little attention. Carlquist’s principles are largely natural history tests, and don’t translate well into the theoretical, design of preserves, or the experimental domains—whereas other competing models do well in such domains. Thirty-four states, the District of Columbia, and Puerto Rico have legalized medical cannabis. While no two state medical cannabis programs are alike, public health concerns related to advertising, packaging and labeling, pesticide use, scientific research, and the role of medical cannabis in the opioid crisis are emerging across the country. This article examines these issues, the policy approaches states are adopting to protect patients and the public, and an assessment of the underlying federal legal landscape.

Low mean fundamental frequency (F 0) in men’s voices has been found to positively influence perceptions of dominance by men and attractiveness by women using standardized speech. Using natural speech obtained during an ecologically valid social interaction, we examined relationships between multiple vocal parameters and dominance and attractiveness judgments. Male voices from an unscripted dating game were judged by men for physical and social dominance and by women in fertile and non-fertile menstrual cycle phases for desirability in short-term and long-term (...) relationships. Five vocal parameters were analyzed: mean F 0 (an acoustic correlate of vocal fold size), F 0 variation, intensity (loudness), utterance duration, and formant dispersion (D f , an acoustic correlate of vocal tract length). Parallel but separate ratings of speech transcripts served as controls for content. Multiple regression analyses were used to examine the independent contributions of each of the predictors. Physical dominance was predicted by low F 0 variation and physically dominant word content. Social dominance was predicted only by socially dominant word content. Ratings of attractiveness by women were predicted by low mean F 0, low D f , high intensity, and attractive word content across cycle phase and mating context. Low D f was perceived as attractive by fertile-phase women only. We hypothesize that competitors and potential mates may attend more strongly to different components of men’s voices because of the different types of information these vocal parameters provide. In two studies, we explored the frequency and phenomenology of musical imagery. Study 1 used retrospective reports of musical imagery to assess the contribution of individual differences to imagery characteristics. Study 2 used an experience sampling design to assess the phenomenology of musical imagery over the course of one week in a sample of musicians and non-musicians. Both studies found episodes of musical imagery to be common and positive: people rarely wanted such experiences to end and often heard music that (...) was personally meaningful. Several variables predicted musical imagery, including personality, musical preferences, and positive mood. Musicians tended to hear musical imagery more often, but they reported less frequent episodes of deliberately-generated imagery. Taken together, the present research provides new insights into individual differences in musical imagery, and it supports the emerging view that such experiences are common, positive, and more voluntary than previously recognized. Drawing on previously unknown or unassimilated sources, Donald C. Hodges here presents an entirely new interpretation of the politics and philosophy of Augusto C. Sandino, the intellectual progenitor of Nicaragua's Sandinista revolution. The first part of the book investigates the political sources of Sandino's thought in the works of Babeuf, Buonarroti, Blanqui, Proudhon, Bakunin, Most, Malatesta, Kropotkin, Ricardo Flores Magón, and Lenin—a mixed legacy of pre-Marxist and non-Marxist authoritarian and libertarian communists. The second half of the study scrutinizes the philosophy (...) of nature and history that Sandino made his own. Hodges delves deeply into this philosophy as the supreme and final expression of Sandino's communism and traces its sources in the Gnostic and millenarian occult undergrounds. This results in a rich study of the ways in which Sandino's revolutionary communism and communist spirituality intersect—a spiritual politics that Hodges presents as more realistic than the communism of Karl Marx. While accepting the current wisdom that Sandino was a Nicaraguan liberal and social reformer, Hodges also makes a persuasive case that Sandino was first and foremost a communist, although neither of the Marxist nor anarchist variety. He argues that Sandino's eclectic communist spirituality was more of an asset than a liability for understanding the human condition, and that his spiritual politics promises to be more relevant than Marxism-Leninism for the twenty-first century. Indeed, Hodges believes that Sandino's holistic communism embraces both deep ecology and feminist spirituality—a finding that is sure to generate lively and productive debate. (shrink)

Among multiple legal challenges to the Patient Protection and Affordable Care Act (PPACA) is the premise that PPACA's “individual mandate” (requiring all individuals to obtain health insurance by 2014 or face civil penalties) is inviolate of Congress' interstate commerce powers because Congress lacks the power to regulate commercial “inactivity.” Several courts initially considering this argument have rejected it, but federal district courts in Virginia and Florida have concurred, leading to numerous appeals and prospective review of the United States Supreme Court. (...) Despite creative arguments, the dispositive constitutional question is not whether Congress' interstate commerce power extends to commercial inactivity. Rather, it is whether Congress may regulate individual decisions with significant economic ramifications in the interests of protecting and promoting the public's health. This article offers a counter-interpretation of the scope of Congress' interstate commerce power to regulate in furtherance of the public's health. (shrink)
